These Terms of Service ("Terms") govern your access to and use of SepticReminder, a service provided by bmango LLC ("Company", "we", "our", or "us"). By accessing or using our website at septicreminder.com or purchasing our service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of the updated Terms.

Service Description

SepticReminder provides personalized septic system maintenance reminders and scheduling services. Specifically, we offer:

• Calculation of maintenance schedules based on EPA guidelines, your household size, tank capacity, and system details
• Generation of a personalized maintenance schedule PDF
• Email reminders before scheduled pump dates and inspections (all plans)
• Text message reminders (Premium plan only)
• Seasonal maintenance tips tailored to your climate zone

The Service is designed to help homeowners track and maintain their septic systems according to best practices. We use EPA-published pump interval tables and industry standards to calculate recommended maintenance schedules.

Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Pricing and Payment Terms

One-Time Purchase

SepticReminder is sold as a one-time purchase. There are no subscriptions, recurring charges, or hidden fees. You pay once and receive ongoing reminders for as long as you use the Service.

Current pricing:

• Essential Plan: $39 one-time (email reminders only)
• Premium Shield Plan: $59 one-time (email + text message reminders)

We reserve the right to modify our pricing for future customers. Your one-time purchase price is locked in and will not change.

Payment Processing

All payments are processed securely through Stripe, Inc. We do not store your credit card information. By providing payment information, you authorize us to charge your payment method for the one-time fee.

All fees are in U.S. dollars and are non-refundable except as expressly set forth in our Refund Policy below.

Refund Policy

We stand behind our Service and want you to be completely satisfied with your purchase.

If you are not satisfied with SepticReminder for any reason, you may request a full refund within 30 days of your purchase date. No questions asked.

How to Request a Refund

To request a refund, email us at hello@septicreminder.com with:

• Your name and email address used for purchase
• Your purchase date (if known)
• Brief reason for the refund request (optional but appreciated for improvement purposes)

Refunds will be processed within 5-7 business days and will be credited to the original payment method. After the 30-day window, all sales are final.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Use any robot, spider, or other automatic device to access the Service for any purpose without our express written permission
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
• Attempt to reverse engineer, decompile, or disassemble any software or algorithms used in the Service
• Share your account credentials with others or allow others to use your account

Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and the design, selection, and arrangement thereof) are owned by bmango LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on our Service
• Use the Service or any content for commercial purposes without our express written consent
• Remove or alter any copyright, trademark, or other proprietary notices

The personalized maintenance schedule PDF generated for you is licensed for your personal use only. You may print and store this document for your records.

Disclaimer of Professional Services

Accuracy of Information and Recommendations

We calculate pump intervals and maintenance schedules using EPA-published frequency tables based on tank size, household occupancy, and system type. While we strive for accuracy, our recommendations are estimates based on typical usage patterns.

Actual maintenance needs may vary based on:

• Water usage patterns and household behavior
• Local regulations and requirements
• Soil conditions and drain field capacity
• System age and condition
• Climate and seasonal factors
• Use of garbage disposals or water softeners

You are responsible for monitoring your system's performance and having it inspected by qualified professionals. Our reminders are supplemental guidance only and should not replace professional oversight.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BMANGO LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Septic system failure, malfunction, or damage
• Property damage, personal injury, or environmental contamination resulting from septic system issues
• Missed maintenance, delayed reminders, or inaccurate recommendations
• Reliance on our recommendations or schedules

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE (I.E., $39 OR $59).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER BMANGO LLC NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, NEITHER BMANGO LLC NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT THE SERVICE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

Indemnification

You agree to defend, indemnify, and hold harmless bmango LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Governing Law and Jurisdiction

These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Texas, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

Informal Resolution

If you have any dispute with us, you agree to first contact us at hello@septicreminder.com and attempt to resolve the dispute informally. We commit to working in good faith to resolve any concerns.

Arbitration Agreement

If we cannot resolve the dispute informally within 30 days, you agree that any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted in Texas, and judgment on the arbitration award may be entered in any court having jurisdiction. Each party will bear its own costs and expenses in the arbitration.

Class Action Waiver

You agree to bring any dispute in arbitration on an individual basis only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. There will be no right or authority for any dispute to be brought, heard, or arbitrated as a class action.

Termination

Termination by You

You may terminate your use of the Service at any time by contacting us at hello@septicreminder.com and requesting account deletion. Please note that termination after 30 days of purchase does not entitle you to a refund.

Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Effect of Termination

Upon termination, you will no longer receive maintenance reminders. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will make reasonable efforts to notify active customers of significant changes.

We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service, except as required by law.

Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. We will notify you of material changes via email to the address associated with your account.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and bmango LLC regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
